Creation of the Ohio McGivney Pooled Special Needs Trust
The creation of this Trust is an extension of the charitable works done
by the Ohio State Charity
Foundation and other activities on behalf of the
mentally retarded, the mentally disable, the disabled due to old age, a
debilitating disease, otherwise physically disabled, and other similarly
disabled persons in our community.

How to Join
An individual may join the Pooled Trust by executing an Individual
Beneficiary Agreement (hereinafter referred to as IBA) and depositing, with the
Pooled Trust, monies that they have inherited, or received via civil litigation.
The Pooled Trust would then hold these monies on behalf of the beneficiary for
payment of special needs directly to the vendor of the beneficiary. By
doing so, the beneficiary preserves his or her rights to Social Security
Disability, Social Security Supplemental Income and/or Medicaid under Federal
law.

How to Sign Up for a Disabled Individual
A parent, grandparent, and/or court may create an Individual Beneficiary
Agreement on behalf of a disabled person. Again, the monies would be
retained in an account identified for that beneficiary to pay for the special
needs as permitted by Federal and Ohio law.
