Under
current Federal law, individuals who need to qualify for or utilize government
assistance benefits such as SSI (Supplemental Security Income), and Medicaid
have rules for eligibility. Assets that exceed $1,500 may be placed in a
Special Needs Trust. If the assets are not in a Special Needs Trust, the assets
may be counted against recipients and result in a disqualification or denial of
benefits.
In contrast to
the above, Federal law created a specific exception to the rules that normally
apply to Trusts. If an individual places the assets into a (d)(4)(A) individual
or a (d)(4)(C) Pooled Special Needs Trust, the assets will not be counted as an
available resource, which will allow the individual to qualify for government benefits.
Therefore, trust
beneficiaries can continue receiving benefits and have trust funds available for
their special or supplemental needs.
